Professor Jeong Yeol Kim published a sole-authored article, “Single- vs. Multi-Jurisdictional Leniency Policies: An Experiment,” in the Journal of Competition Law & Economics, a top journal in competition policy, on January 26. Motivated by the low rate of leniency (self-reporting) applications under the single-jurisdictional leniency policy widely adopted by competition authorities in Asian countries, the paper uses a laboratory experiment to provide an economics-based framework and to test the validity of a recent OECD roundtable discussion that has called for a “multi-jurisdictional” leniency policy—one that allows competition authorities to recognize leniency applications submitted to other authorities. The paper shows, through an economics experiment, that multi-jurisdictional leniency does not necessarily increase leniency applications, and that mutually guaranteeing full immunity across authorities for self-reporting cases is essential to maximize the effectiveness of the policy.
